"In addition, the government is once again spreading fake news: the majority of the increase in subscription bans is due to day-to-day bans that were only introduced in 2014 due to missed course days, and many other bans are arbitrary."

The Federal Chancellor, who is jointly responsible for numerous unconstitutional laws, not only wants to tighten the enforcement of unemployment insurance administered by social partners, but also people who are looking for work - initially “only” refugees (who are usually not asked for by the economy!) - from Vienna to the forced resettlement in the extreme west. This is unconstitutional in two respects: In Austria, the right to a free choice of residence via the constitutional constitution (§ 4 StGG) and the European Convention on Human Rights (Art. 2 4th ZP ECHR) have constitutional status. This also violates the protection of private life under Article 8 of the European Convention on Human Rights.

Demanding more pressure on the unemployed is a sign of ignorance!

More pressure on job seekers only favors criminal entrepreneurs, even bankrupts, who are looking for cheap labor supported by the AMS at the expense of the insurance community.

Only recently did the European Court of Justice recognize total sanctions, such as those imposed by the AMS on its own insured on mere suspicion, as fundamentally incompatible with the European Charter of Fundamental Rights (GRC).

Numerous scientific studies and the German Federal Constitutional Court state that the violence of the sanction regime does not have any positive effects on mediation and, on the contrary, even has numerous negative side effects, which the state e.g. in the form of poisoning of the work environment at the AMS, damage to health, homelessness etc. . demonstrate.

Sanctions are imposed quite arbitrarily by disrespectful and often technically overburdened AMS employees, disregarding basic procedural rights on the smallest occasion. Even the desire to negotiate slightly better working conditions or even to have an employment contract checked by a trade union or chamber of labor can lead to the complete withdrawal of insurance benefits for 6 or 8 weeks!

Active unemployed Austria expect at least from Minister of Social Affairs Rudolf Anschober and Minister of Family Affairs Christine Aschbacher a clear commitment to compliance with constitutional law and human rights, in particular the right to freely choose a place of residence and the human right to freely chosen work and unobjective interferences from the Federal Chancellor! The UN had already criticized the AMS sanctions regime and the lack of involvement of those affected in December 2013. The UN will probably have to do it again next autumn at the next state examination!
